Texas Drunk Driver Motorcycle Accident Attorney Michael Grossman Explains Third Party Dram Shop Cases

Most people incorrectly assume that the sole person responsible for a drunk driver motorcycle accident is the driver of the motorcycle themselves. However, this is not always the case. In Texas and other states that have dram shop laws, more than one person can be held liable for an accident involving a drunk motorcycle driver. These third parties can be held liable and responsible for their contributions to a drunken driver motorcycle wreck through either a personal injury lawsuit or a wrongful death lawsuit.

In a successful civil lawsuit against the drunk motorist, a bereaved family member can seek compensation for their loss or injury.

Third Party Dram Shop Claims

In a third party dram shop claim, the victims of the drunk driver motorcycle accident can bring a lawsuit against all parties involved and not just the drunk motorist themselves. In other words, bereaved family members can seek compensation by filing a lawsuit against the server of the alcohol that led to the drunk driver crashing and causing a wreck. An example of this would be an establishment or business that serves alcohol, such as a bar or restaurant, who over served their patron alcohol that exceeded the legal blood alcohol level, causing their patron to become drunk and a hazard to others. In this case, the negligent bar or restaurant can be held as a proximate-cause of the accident victim’s injury or death. This actually means that the drunk driver motorcycle accident was directly caused by the bar or restaurants gross negligence in over serving alcohol. If the bar or alcohol serving establishment followed rules and did not over serve alcohol, then the victim would not be injured in the first place. Also, this means that both the drunk motorcycle driver and the alcohol serving establishment can be held liable in a personal injury lawsuit or a wrongful death lawsuit.

Even though more than one party can be held liable in a Texas drunk driver motorcycle accident case, one party cannot be the sole liable party responsible for damages. For example, a bar or restaurant that was involved in a drunk driving motorcycle case cannot bear sole responsibility when it comes to a wreck involving alcohol. Since the bar or restaurant contributed in some part to their patron becoming drunk because the server over served the alcohol amount allowing the patron to drive drunk, they will only ever bear a partial amount of the liability involved in the motorcycle wreck. In addition, the bereaved family member or injured victim cannot sue the bar or restaurant for 100 percent of the damages. An example of this would be when a victim of a motorcycle wreck involving alcohol incurred nearly $200,000 worth of damages in the form of medical bills, lost wages, and pain and suffering. In this case, the drunk driver is found to be 40 percent liable whereas the restaurant or bar is found to be 60 percent liable. Therefore, the bar or restaurant in this case is only responsible for paying the $120,000 in damages as a result of the motorcycle drunk driving wreck. This is another reason why it is critical that a victim of a Texas drunk driver motorcycle accident contact an experienced attorney who can determine the level of liability and amount of negligence that a bar or alcohol serving establishment owes to the plaintiff. If all liable parties are not found in a Texas drunk driver motorcycle accident case, then the victim might not be able to receive the full and maximum amount of compensation available to them.

Motorcycle Wrecks vs. Car Wrecks

When it comes to vehicle accidents, it is often easy to distinguish the difference between a motorcycle wreck and a car wreck. First of all, motorcycle wrecks often result in more severe personal injury than does a regular car wreck. Motorcycle wrecks also result in a higher amount of deaths than regular car wrecks. The latest Texas Department of Transportation Study shows that two-thirds of all motorcycle accidents in Texas results in either severe personal injury or death towards the motorcycle rider. In 2009, there were 434 fatal motorcycle accidents, which accounted for 14 percent of Texas traffic fatalities that year. Furthermore, in Texas, 5,800 motorcycle riders or passengers were injured in 2009 also. The main reason why motorcycle riders and passengers suffer either severe personal injury or death is due to the fact that they are not as protected as well as regular car drivers. For example, a passenger vehicle by its very own construction of parts and enclosed parts affords a lot more protection than does a motorcycle type vehicle. Due to its lack of outer frame, a motorcycle, no matter what type or brand, does not have the protection or outer shield that a regular car does to prevent the driver from being severely injured. Event the most popular and well built brands of motorcycles such as a Ducati, Honda, Kawasaki, Suzuki, Yamaha, Harley-Davidson, Buell, Triumph, and other motorcycle manufactures are helpless when it comes to protecting their drivers due to the fact that a motorcycle does not have an outer-shield to protect the driver or the passenger from harm even in the smallest of wrecks.

Due to this very fact, motorcycle accident cases are dealt with entirely differently than regular car wreck cases. Many people fail to even see this. In a typical passenger vehicle case involving a car accident, the accident can be resolved without the assistance of an attorney. However, this is not the case when it comes to motorcycle accidents, especially a motorcycle accident that involves a drunk driver. Due to the severe personal injuries suffered as a result of the motorcycle wreck, it almost always requires the assistance of an experienced attorney to handle the case so that the injured party can receive the maximum amount of liability in their case. One always needs the assistance of a Texas motorcycle accident law firm such as the Texas drunk driver motorcycle accident attorneys of Grossman Law Offices. At Grossman Law Offices, our attorneys have 20 years experience litigating cases involving these types of cases. Also, in motorcycle accident cases, you will most likely have to deal with aggressive insurance agents due to the high dollar amount of damages involved in the case as a result of the severe personal injuries involved in such types of wreck. Without the assistance of an experienced attorney to help you or your bereaved family fight the aggressive insurance companies, you might end up settling for a very unfair and low offer regarding your damages in your motorcycle accident case. Without the legal experience of Grossman Law Offices, you will probably be taken advantage of by the insurance companies who are only after their own interests and not protecting yours.

Texas Motorcycle Injury Accidents

Motorcycle Injuries come in many forms and ranges. Motorcycle injuries can be mild such as bruises and scratches, or they can be severe and life threatening, such as a brain injury or spinal cord injury. Also, one can also experience road rash, which is a minor injury as well. If you do not treat road rash promptly, then this injury can turn severe through an infection as well. It is also important to note that if you do develop a road rash due to a motorcycle accident, then you need to treat it promptly before it turns into an infection. You need to seek medical attention fast. When you do seek the correct medical attention, you can be sure that you are able to seek compensation for the road rash injury also. However, if you do nothing and let the road rash injury continue without proper treatment, then you may not be able to seek financial compensation if your road rash turns into an infection. In other words, if your road rash injury becomes a severe infection because you failed to treat it, then the liable party or parties involved in your motorcycle accident cannot be held accountable for this type of infection.

Another serious injury that many motorcycle accident victims suffer from is broken bones and bone fractures. Due to the fact that motorcycle drivers and passengers are in the open air without any enclosed parts shielding them from outside elements, they are often ejected from the motorcycle when they are in an accident and fall to the ground. The strong force to which they fall to the ground often results in broken bones, broken arms or broken legs. Even though broken bones require immediate medical attention, these same type of injuries are life altering and may make one become immobile and therefore suffer financial loss as well for their inability to use their body. In this situation, one needs to seek a Texas personal injury lawsuit in order to recover for their lost wages.

Also, severe motorcycle injuries include things such as spinal cord injury, traumatic brain injury, and disfigurement. All of these injuries can result in life-altering medical conditions which need constant medical attention. Furthermore, a motorcycle accident victim can also suffer from burns associated with the accident. The burn injuries can be painful and cause a lot of suffering and disfigurement for the victim as well. The motorcycle accident can also leave many scars on the face, hands, legs, neck or back which can be hard to overcome. Also, a victim might lose their limbs such as having a leg or arm amputated as a result of the accident. This ordeal can also alter the life of an individual and even diminish it. In summary, all of these injuries end up causing severe emotional stress on the victim. This is why it is important that if you have been severely injured in a Texas Drunk Driver Motorcycle Accident, you need to seek legal help in the form of a personal injury lawsuit. This way, you can overcome your injury or loss and start to heal by getting the financial compensation you deserve for your injuries or loss associated with the accident.

In Texas, the law requires that anyone under 21 must wear a helmet when they are on a motorcycle. For those 21 years and older, wearing a helmet is optional if they have proven that they have taken a Texas motorcycle rider training course or if they can show proof of having health insurance. There have been many years of debate on whether wearing helmets should be required for all motorcycle riders. However, the safety factors of wearing a helmet and the benefits associated with wearing a helmet is hard to refute. Motorcycle helmets can prevent the most severe injuries such as spinal cord injuries or brain injuries from occurring. These injuries may also result in paralysis and require life-long treatment with constant medical attention. Furthermore, the costs associated with dealing with these life-altering injuries are enormous as well. In fact the people that need the greatest legal help are those victims of motorcycle accidents who end up having to deal with severe injuries such as spinal cord injuries or traumatic brain injuries. They need to seek the proper legal counsel so that they can get the maximum amount of compensation they deserve to overcome their injuries.

Motorcycle injuries vary. Sometimes, the injuries a victim suffers needs to be treated only for a day. Other injuries require more medical attention and can take several months, years or even a lifetime to deal with. The bad news is that medical costs associated with these injuries can be very expensive ranging from a thousand dollars to a million dollars overtime. In these types of cases, an insurance company whose client is at fault for the accident, will aggressively fight the plaintiff in the case in order to not pay them the amount they are owed due to the large costs associated with motorcycle injuries. This is why it is equally important to hire an experienced attorney to fight for your rights so they can get you the financial compensation you deserve. If you do not get strong legal help, then you might end up getting a lot less than you deserve in your case.

Fatal Motorcycle Accidents in Texas

Every day, a motorcycle accident occurs in the state of Texas. This is according to the Texas Department of Transportation. Because of this statistic, it is said that this sobering fact means that everyday one family in Texas can lose a loved one due to a motorcycle crash. If you or a loved one lost a family member due to a Texas motorcycle crash accident, then the Grossman Law Offices Texas wrongful death attorneys can investigate the case and the accident scene to identify all the liable parties involved in your loved one’s loss. When an accidental death happens because of the gross negligence of another party, then the bereaved family member of the victim has the right to pursue a wrongful death civil lawsuit against all negligent parties in order to seek compensation for all types of damages which include wrongful death damages and survival damages.

In survival damages, only one family member can seek compensation for their losses. This family member is the closest living family member to the victim. However, in a wrongful death damages case, more than one family member can seek damages on behalf of the victim. In survival damages and wrongful death damages case, the bereaved family members can seek financial compensation for their financial losses associated with their loved one’s loss. However, even though family members may seek these types of damages, often times their ultimate goal is not so much to seek compensation but to hold the negligent parties involved in your loved one’s loss accountable for their negligent behavior which led to the motorcycle accident injury or death. The bereaved family member’s goal is to bring all negligent parties to justice. Before filing a lawsuit, a bereaved family will contact a fatal motorcycle accident attorney in Texas so that the attorneys can conduct an independent investigation into the motorcycle accident. This way, the attorneys can identify what caused the accident and find all the negligent parties involved with your loved one’s loss. Afterwards, each individual party can be sued for their particular role and actions in causing or contributing to the motorcycle accident. Drunk Driving Motorcycle Accidents in Texas

Drunk driving cases involving regular passenger vehicles are the same as drunk driving involving motorcycle type vehicles. Both allow lawsuits to be brought against bars or restaurants that over served their patrons who ended up causing the motorcycle fatal accident or passenger vehicle accident. In Texas, the dram shop law makes it to where a bar or restaurant can be found liable if their servers over served alcohol to their patrons where their patrons blood alcohol level exceeded the legal amount of less than .08%. If the patrons’ blood alcohol level exceeded .08%, and the patron ended up being drunk and caused harm to themselves and others, then the bar or restaurant can be held partially liable for such a drunk driving wreck. In this instance, a injured victim of the drunk driver motorcycle accident case can seek legal action and compensation in the form of a third party dram shop cause of action, against the drunk driver and the negligent bar or restaurant. This same form of liability can be established in the form of a wrongful death lawsuit. However, the tricky part is being able to establish how the patron was over served alcohol at the bar or restaurant prior to causing the accident. This can be hard and difficult for attorneys or individuals who have no prior experience proving these types of cases. The Texas drunk driver motorcycle accident lawyers of Grossman Law Offices have 20 years of experience in handling drunk driving accident cases in Texas. Our attorneys of Grossman Law Offices have 20 years of experience in Texas dram shop law and know how to identify all the negligent parties involved in your loved one’s loss and know how to bring them to justice.

Adjuster and Jury Bias in Texas Motorcycle Accident Cases

Unfortunately, motorcycle riders are not viewed favorably by the public and may face a lot of bias. The general public often views motorcycle riders and passengers as a wild bunch that are wreck less in their ways and behaviors. Due to this negative image by the public, insurance adjusters and defense attorneys will use this imagery and strategy to sway the jury on their side, putting blame on the motorcyclist 100 percent. If the insurance company and defense attorney are able to have success with this strategy, then they can save their company tons of money as well. If the insurance adjuster can prove to the jury that the motorcycle driver is mostly responsible for his or her own wreck, then the insurance company stands a chance of saving their company a substantial amount of money. The sad fact is that even if a motorcycle driver sustains severe injury as a result of the motorcycle accident, their claim can still be denied for seeking fair compensation. An insurance adjuster will often work hard to make sure their claim is denied in order to save money. This is another critical reason why a motorcycle rider needs to contact an experienced attorney who has handled motorcycle accident cases in Texas. It is better that the motorcycle rider contact an attorney before handling the case on their own. If they try to handle the case on their own, they might end up hurting themselves more in the end. There is so much money at stake that if they handle the case by themselves, then they might not receive all the compensation they need for things like medical bills, lost wages and pain and suffering. With the legal help available from the Texas motorcycle accident attorneys of Grossman Law Offices, our legal team will work against any biases or tricks that the insurance adjusters or defense attorneys will try to use against you or your loved ones.

Aggressive Insurance Adjusters

As we mentioned before, insurance adjusters are scared of losing a lot of money to motorcycle accident victims and therefore will do anything in their power to deny claims. The last thing insurance adjusters want is to be able to award a large sum of money to motorcycle accident victims despite the victims need for proper compensation. In many cases, insurance adjusters receive bonuses for their ability to save the insurance company money by denying claims or for being able to offer a lesser amount in damages to the victim. As a result, the insurance adjuster is only working for his or her own good and benefit and could care less about the accident victim or his or her bereaved family. Due to this fact, an insurance adjuster will see to it that the victims claim is completely denied or lessened.

For example, an insurance adjuster will do this by placing blame on the motorcycle accident completely on the driver themselves and not on any other third party. If the defense attorney and insurance adjuster are able to place 100 percent of the blame on the motorcycle accident victim, then the claim can be dismissed. However, if other third parties are involved, then the insurance company will have to pay less in compensation. As a result, the insurance adjuster will try to pin 100 percent of the blame on the motorcycle accident victim so that the case can be dismissed. They will even try to badger the motorcycle accident victim with several questions in order to skew their memory regarding the accident. Such missteps will be recorded then used against the victim in order to question their credibility and memory regarding the motorcycle accident. What’s even more damaging is when a defense attorney has conducted an accident scene investigation before the plaintiff does. The insurance adjuster can use the investigation conducted by the defense attorney to claim an open and shut case against a motorcycle accident victim. Without the proper evidence needed in order to back up your case in the accident, you stand a very little chance of being able to refute or challenge the allegations made against you by the insurance adjuster or defense attorneys.

Another tactic used by insurance adjusters in order to save money is their ability to offer you or your bereaved family members’ quick compensation. They will often do this by making you or your loved ones sign documents waiving your rights to sue or receive further compensation. In order to receive the quick sum of money, the insurance adjusters will make you sign documents. This is a shrewd tactic used by insurance adjusters so that they can save money. More often than not, they will offer you a low ball amount of money. When a victim does accept the offer and signs the papers, then they are also signing away their rights to further sue those responsible for your accident. If the insurance adjuster is able to get a hold of the motorcycle accident victim before they have the opportunity to speak with a Texas motorcycle accident lawyer themselves, then the insurance adjuster has a really good chance of settling with the accident victim for a lot less money. However, if they are able to get the case completely dismissed, then they have attained victory for themselves as well.

$350,000.00 Recovery - Wrongful Death / First Party Dram Shop
Our firm was hired by the minor child and parents of a young man who was killed in a motorcycle accident after being over served alcohol at a South Padre Island bar. The plaintiffs hired our firm to investigate the claim on the basis that the decedent was over the legal limit at the time of his death. In initial attempts to settle the case out of court, the defendants denied liability. Suit was filed soon thereafter.

The defendants initially argued that the decedent never consumed alcohol on their premises. Through physical evidence and deposition testimony to the contrary, we were able to conclusively prove that the decedent had indeed been drinking at the establishment.

The defendants then asserted allegations that the decedent's minor child was not actually his biological child, which would bar his claim entirely. A DNA test was performed and this argument was defeated.

The defendants then asserted the safe harbor defense. Our attorneys argued that the defendants did not qualify for safe harbor protection due to the fact that their servers were not all licensed providers. However, while this element was being addressed, our attorneys focused their attention on addressing the second element of the safe harbor defense regarding the bar's encouragement of the over service of alcohol. The defendants claimed that they would never serve the double-shot Bacardi cocktails that witnesses claimed the decedent drank several of. We sent private investigators into the bar to order the same drinks that the decedent consumed on the night of his death and the very same bar tenders who over served the decedent, without hesitation, served copious amounts of alcohol to the investigators, all of which was captured on hidden camera.

Once the safe harbor defense was defeated, the defendants argued that the decedent's BAC was low enough at the time of his death (as recorded by the hospital) that he would not have necessarily appeared obviously intoxicated to the servers and therefore the bar should not be held liable even if he had been over served. Eyewitness testimony refuted this.

Additionally, our firm's testifying medical expert reviewed the medical records related to the emergency helicopter flight that transported the decedent to the hospital after his accident. She determined that the EMS technicians administered numerous blood transfusions while in flight. Armed with this newfound data, our medical expert reverse extrapolated and determined conclusively that the decedent's BAC was actually in the range of .19-.21 at the time of the accident, though it was drastically diluted by the time he arrived at the hospital, which accounted for the relatively low BAC found in the hospital's medical records. This testimony proved to be pivotal in the case, resulting in a successful recovery for our clients.
